Terms and Conditions These terms govern the use of products and services provided by Dave in the Shed Productions, LLC ("the Company").
- Ownership: All musical works, including backing tracks, original compositions, and "Atmospheres" collections, are the sole intellectual property of Dave Maffris.
- Backing Tracks (One-Time Purchase): Purchased backing tracks are licensed for live performance use only. They may not be resold, redistributed, or used in commercial recordings/videos without express written consent and a separate mechanical license.
Atmospheres Subscription Services:
- License Grant: A valid subscription to an "Atmosphere" collection grants the Licensee a non-exclusive right to stream the music as background audio within one (1) physical business location.
- Public Performance (Direct Grant): Notwithstanding the Licensor’s membership in ASCAP, the Company hereby grants a Direct Public Performance License for the music provided via the Atmospheres stream. The subscription fee is "all-in," and the Licensee shall not be required to pay additional performance royalties to PROs for the use of this specific stream.
- Access & Termination: Access is provided via a streaming link (e.g., DISCO). This is not a download. Upon cancellation or non-payment, the right to perform the music publicly ceases immediately, and the stream link will be deactivated.
- Modifications: The Company reserves the right to update, swap, or modify tracks within a collection to maintain "seasonal relevance" and quality.
4. Refund Policy: Due to the digital nature of these products, all sales are final. For subscriptions, users are encouraged to utilize the 30-Day Pilot Evaluation to ensure the service meets their needs before a paid license begins.
5. Governing Law: These terms are governed by the laws of the State of North Carolina.
